New Zealand takes its second legislative step towards plain packaging for tobacco products

The Smoke-free Environments (Tobacco Plain Packaging) Amendment Bill ("the Bill”), which aims to amend the Smoke-free Environments Act 1990 to give effect to the Government’s decision of 18 February 2013 to introduce a plain packaging regime for tobacco products in New Zealand, has been examined by the Health Committee (“the Select Committee”) which recommends that it be passed subject to minor amendments. For further background information see our article on the Bill following its first reading.

The Select Committee received and considered 15,682 submissions from interested groups and individuals and heard oral evidence from 33 submitters.

The Bill and subsequent regulations will set out detailed requirements for the design and physical appearance of any packaging used or intended for use with tobacco products, and of the tobacco products themselves, that must be complied with for tobacco products manufactured, distributed, or sold in New Zealand.

The Bill will also amend existing regulation-making powers regarding health warnings on tobacco products to broaden their scope to include warnings of wider adverse social and economic effects, and also to allow positive health promotion messages. The Bill will also create new offences with substantial penalties to deter and punish non-compliance.

The Select Committee Report (dated 5 August 2013) notes:

“The bill would not have any effect on intellectual property rights to register, own, and enforce trademarks and copyright in designs; it is only the use of trademarks and copyrighted designs as promotional devices on tobacco products and packaging that would be controlled.”

An interesting amendment is to the title of the Bill which the Select Committee recommends is changed to Smoke-free Environments (Tobacco Standardized Packaging) Amendment Act 2013, as this is considered to “reflect more accurately the intended consequences of the bill”.

The Bill is now available for its second reading.

Aiming for a tobacco-free Pacific

The World Health Organiztion has launched its Tobacco Free Pacific Campaign in a bid to help the region reduce smoking prevalence to less than 5 percent by 2025.

A tobacco control advisor, Ada Moadsiri says adult tobacco use for males in Kiribati is the highest in the region at 74 percent, and for women in Nauru, with 56 percent being smokers.

She while the smokefree goal is ambitious, it has support from communities and political commitment and she is confident it will be successful.

"Pacific Islands are taking action such as declaring smoke-free public places to protect people from the dangers of second-hand smoke. They are also raising tobacco taxes which makes them more expensive and thereby decreasing consumption of tobacco products, which then decreases death and disease, and they're also enforcing tobacco control legislation."

Ada Moadsiri says the project is funded by New Zealand Aid, which is also providing support to help fight smoking-related illnesses such as cardiovascular disease.

Shops caught in tobacco sting

Tobacco sellers across Wellington and the Hutt Valley have been busted selling the product to minors.

Five stores in the Hutt Valley were visited by an undercover volunteer. Two sold tobacco to the underage participant.

Another two in Wellington and the Kapiti Coast sold the products without asking for identification, out of 15 tested. Those caught faced a $1000 fine.

Eleven of the 20 retailers that were tested had previously sold tobacco to a minor in the last year. None of those re-tested failed a second time.

The wider Wellington region had the worst results of the wider lower North Island sting. Two out of 29 retailers in Wanganui sold to the underage volunteer, though all stores in the Wairarapa and Hawke’s Bay asked for identification.

Tobacco boss fights packaging bill
Imperial Tobacco is fighting plans to introduce plain packaging for cigarettes.

Senior manager at Imperial Tobacco Dr Axel Gietz on Wednesday made a submission to the Health Select Committee arguing against plain packaging.

The Committee is hearing submissions on the Plain Packaging Bill which would have all tobacco products sold without branding.

Dr Gietz told Nine to Noon a KPMG report on Australia's two year experience with plain packaging showed the bill would remove brand competition and force companies to compete on price, making tobacco cheaper.

He defended the veracity of the report, despite it being commissioned by tobacco companies.

Dr Gietz says it is too early to say whether Imperial Tobacco would seek compensation if the act passes into law, but legal action can't be discounted.

Ban roll-your-own tobacco – expert

Roll-your-own tobacco is ''more dangerous'' than factory-made cigarettes and should be banned, says Professor Richard Edwards, head of public health at the University of Otago's Wellington campus.

Prof Edwards said roll-your-own tobacco was less natural and at least as harmful as factory-rolled tobacco and interventions were needed to encourage roll-your-own smokers to quit.

The interventions included mass media campaigns and pack warnings to correct misinterpretations that roll-your-own cigarettes were less hazardous and more natural.

Loose tobacco more dangerous than factory-made cigarettes: New Zealand expert
Special measures might be needed to curb a rising tendency in Western nations for smokers to roll their own cigarettes -- either to cut the cost of smoking or from a belief that loose tobacco is less hazardous than factory- made cigarettes, a New Zealand expert warned Wednesday.

Evidence showed that roll-your-own (RYO) cigarettes were at least as harmful as the factory-rolled type, although many RYO smokers falsely believed they were more "natural" and less dangerous, said University of Otago Wellington Professor of Public Health Richard Edwards

Fewer Cantabrians puffing on tobacco

Fewer Cantabrians than previously thought are smoking to deal with post-quake stress.

The number of Canterbury adults regularly smoking has dropped from 19 per cent in 2006 to 14.6 per cent last year, newly released Census data show.

During that time, 14,997 fewer people turned to tobacco, debunking findings of recent studies suggesting more people were lighting up in the wake of the earthquakes.

A notable decrease was also recorded among the region's young smokers.

New Zealand to Pass Tobacco Packaging Bill; Second Country after Australia to Impose Plain Packaging

The tobacco packaging bill has been introduced in New Zealand, but it will not be passed as a law until Australia has settled the legal action. New Zealand's Associate Health Minister Tariana Turia had introduced to Parliament the bill on Dec 17, known as the Smoke-Free Environments Amendment Bill.

Tobacco plain packaging debate early next year

Parliament will begin its debate on plain packaging for tobacco early next year, Associate Health Minister Tariana Turia has confirmed.

Mrs Turia said this morning she expected the Smoke-Free Environments (Tobacco Products and Packaging) Amendment Bill to be introduced to the House in the New Year.

The hard-hitting law change would require cigarettes and tobacco to be sold in standardized packets with large health warnings.

In a statement, the minister said removing tobacco company colors, logos and other marketing designed to make tobacco products glamorous was an important step in reducing the uptake of smoking.

Tobacco firms sidestep tax rises

Opposition MPs say tobacco companies are "gaming" tax rules to reap profits from annual excise increases, profiting from measures designed to curb smoking.

Tobacco companies are avoiding millions of dollars’ worth of tax increases each year by triggering huge excise payments just before the end of December, then keeping the annual increase on New Year sales.

A timing loophole creates an entirely legal way to make a windfall from tax increases.

Last year the Government announced there would be 10 per cent increases in tobacco excise, on top of inflation adjustments, each year for four years, on January 1.

Emily left smoking due to OZ’s intense new tobacco law

It is question to be asked that has Australia's intense new tobacco bundling law had any effect on smokers. An example can explain this.

Emily Howard, 26, a Department of Defence representative, began smoking at 15. She was humiliated by the propensity, she says, in light of the fact that her accomplice and most companions did not impart it.
